LIQUOR LICENCE NOTICE:
Silverfern Ventures Pty. Ltd. holds Victorian Remote Seller’s Liquor Licence No. 36314601 issued under the Liquor Control Reform Act 1998 (Vic), valid to 31 December 2026. The supply of alcohol is strictly limited to persons aged 18 years or over. It is an offence under Victorian law to supply alcohol to a minor or to obtain alcohol on behalf of a minor. Liquor deliveries operate only within the licensed trading hours set out in these documents.
Terms and Conditions of Sale
1. Introduction and Acceptance
These Terms and Conditions (“Terms”) govern your purchase of liquor products from Silverfern Ventures, a remote seller operating in Victoria, Australia. By placing an order through our website, you agree to be bound by these Terms. Please read them carefully before purchasing.
These Terms are governed by the laws of Victoria and the Commonwealth of Australia, including the Liquor Control Reform Act 1998 (Vic), the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)), and the Australian Privacy Principles. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of Victoria.
We may update these Terms at any time. The current version will always be published on our website with the effective date noted. Continued use of our website after any update constitutes acceptance of the revised Terms.

3. Licence Type — Remote Seller
Silverfern Ventures holds a Remote Seller’s Licence under the Liquor Control Reform Act 1998 (Vic). Under this licence:

We are authorised to supply packaged liquor from our licensed premises for consumption off those premises only.

All orders must be placed via an off-premises request (i.e., online or telephone).

Liquor is supplied for delivery or collection as an off-premises transaction only.
-
We are not authorised to operate as an on-premises venue.
4. Age Verification — 18+ Only
It is illegal to supply liquor to a person under the age of 18 years. By placing an order, you declare that you are 18 years of age or older. We reserve the right to request proof of age at any time, including at the point of delivery.

If our delivery driver has reasonable grounds to suspect a recipient is under 18, delivery will be refused.

It is also an offence to purchase or obtain liquor on behalf of a person under 18.

We may cancel any order where we have reasonable grounds to believe it was placed by or for a minor.

Refunds will not be issued for orders refused on age-verification grounds where the customer provided false age declarations.
Proof of age accepted: Australian driver’s licence, Australian passport, Keypass card, or equivalent government-issued photo ID.
5. Ordering
Orders may be placed through our website at any time, on any day. However, liquor may only be supplied (dispatched or handed over for delivery) during the licensed trading hours set out in clause 6 below.
By placing an order, you represent that:

All information you provide is accurate and complete;

You are the person named in the delivery details.
We reserve the right to accept, decline, or cancel any order at our discretion, including where we suspect fraud or misuse of the platform.
6. Trading Hours and Delivery Hours
In accordance with our Remote Seller’s Licence, liquor may only be supplied and delivered during the following hours:
Monday to Saturday: 9:00 am to 11:00 pm
Sunday: 10:00 am to 11:00 pm
Anzac Day: 12:00 noon to 11:00 pm
Good Friday and Christmas Day: No deliveries or supply permitted.
Orders placed outside these hours will be processed when trading resumes. If you place an order on Good Friday or Christmas Day, it will be processed on the next eligible trading day.
These hours are set by our liquor licence and are not subject to discretion. We may cancel or reschedule deliveries that fall outside permitted hours.
7. Pricing and Payment
All prices are displayed in Australian dollars (AUD) and include GST where applicable. Prices are subject to change without notice. The price charged will be the price displayed at the time your order is confirmed.
We accept payment by methods listed on our website at the time of purchase. Payment is processed securely at the time of ordering.
8. Delivery
Deliveries are made to addresses within our designated service area. Delivery timeframes are estimates only and are not guaranteed. Silverfern Ventures is not liable for delays caused by circumstances outside our control, including but not limited to traffic, weather events, or public holidays.
A person aged 18 or older must be present to receive the delivery. If no eligible person is available to receive the delivery:

The delivery driver will not leave the liquor unattended;

We will attempt to contact you to arrange redelivery;

A redelivery fee may apply;

If redelivery cannot be arranged, your order may be cancelled and refunded minus any applicable delivery or handling charges.
9. Responsible Service of Alcohol
Silverfern Ventures is committed to the responsible service of alcohol. We will not supply liquor to:

A person who is, or appears to be, intoxicated;
-
A person who is, or appears to be, under the age of 18;
-
A person who we reasonably believe intends to supply the liquor to a minor.
If delivery is refused on any of these grounds, no refund will be issued for product already dispatched.
10. Intellectual Property
All content on the Silverfern Ventures website, including text, images, logos, and product descriptions, is the property of Silverfern Ventures or its licensors and is protected by Australian copyright law. You may not reproduce, redistribute, or commercially exploit any content without our prior written permission.
11. Limitation of Liability
To the maximum extent permitted by law (including the Australian Consumer Law), Silverfern Ventures limits its liability for any failure to comply with a consumer guarantee to the resupply of goods or the cost of resupply, at our election.
We are not liable for any indirect, incidental, special, or consequential loss arising from your use of our website or products, including loss of profits or damage to property, except where such liability cannot be excluded by law.
Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the Australian Consumer Law that cannot lawfully be excluded.

Returns and Refunds Policy
1. Our Commitment Under Australian Consumer Law
Our Returns Policy is governed by the Australian Consumer Law (ACL), which is Schedule 2 of the Competition and Consumer Act 2010 (Cth). Under the ACL, you are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
Nothing in this Returns Policy limits or excludes any rights you have under the ACL.
2. Change of Mind
Due to the nature of alcohol products and Victorian liquor licensing regulations, we are unable to accept returns or provide refunds for change of mind. Once liquor has left our licensed premises in a correctly fulfilled order, it cannot be accepted back under our Remote Seller’s Licence.
We encourage you to review your order carefully before confirming purchase.
3. Faulty, Damaged or Incorrect Products
If you receive a product that is:

Damaged in transit;
-
Faulty or defective (e.g., contaminated, corked, or leaking);

Not the product you ordered (incorrect item supplied);

Past its best-before or use-by date at the time of delivery,
please contact us within 48 hours of delivery. We may request photographic or other evidence of the issue.
For confirmed faults or errors, we will at our election:

Replace the product (subject to availability); or
-
Provide a full or partial refund to your original payment method.
4. How to Make a Claim
To request a return or refund, please contact us with:

Your order number;

A description of the issue;

Photographs of the product and packaging (where applicable).
Do not dispose of the product before we have assessed your claim. We may request that faulty goods be held for our collection.
5. Refused Deliveries
If a delivery is refused by us on grounds permitted under our licence (e.g., the recipient appears to be under 18 or appears intoxicated), no refund will be issued where product has already been dispatched in good faith. Redelivery may be arranged at our discretion for a fee.
If a delivery is unsuccessful due to no eligible person being present, we will attempt to contact you to arrange redelivery. A redelivery fee may apply. If redelivery cannot be completed within a reasonable period, the order may be cancelled. A refund will be issued for the product value, less any delivery and handling costs already incurred.
6. Cancellation of Orders
You may request cancellation of an order before it has been dispatched. Once an order is dispatched, it cannot be cancelled.
We reserve the right to cancel an order at any time if:

The order cannot be fulfilled due to stock unavailability;

We have reasonable grounds to suspect the order was placed in breach of these Terms or applicable law;

Delivery cannot be completed within the hours permitted under our liquor licence.
In the event of cancellation by us, a full refund will be issued to your original payment method.
7. Refund Processing
Approved refunds will be processed to your original payment method within 5–10 business days, depending on your payment provider. We will notify you by email once a refund has been processed.
8. Consumer Guarantees
Under the ACL, our products come with guarantees that cannot be excluded, including that they will be:

Of acceptable quality;

Fit for any disclosed purpose;

Matching the description provided.
If a product does not meet these guarantees, please contact us. We will work with you to resolve the issue in accordance with your rights under the ACL.
